Good Sale/Delivery Regulations
The Seller shall transfer the artwork made by the Seller (hereinafter referred to as the “Painting”) into the ownership of the Buyer, and the Buyer shall pay an agreed amount of of money for the selected painting.
Rights and Obligations of the Parties
The Buyer shall:
– Make payment for the Painting, within three business days, after providing the calculation of its cost and delivery.
– When accepting the Painting from the Seller, the Buyer shall verify the conformity of the characteristics of the Painting.
– Upon detection of a defect in the received goods, the Buyer shall have the right to send a written claim to ksambuca.art@gmail.com with photos and a description of the goods defect, specifying the date of detection, as well as to report the detection of the defect by means of cellular communication / WhatsApp.
– Buyer shall have the right to return the defective goods to the following address: Kazakhstan, Almaty city 30/37 Kazakhfilm microdistrict. The costs of delivery of defective goods shall be borne by the Seller.
– The Buyer shall have the right to return the goods within 14 calendar days without giving any reason. In case of return of goods for reasons other than goods defects, the costs of delivery of the goods shall be borne by the Buyer.
– The Buyer shall have the right to refuse the purchase of the Painting without giving any reason within 3 calendar days from the date of payment. In order to withdraw from the contract, the Buyer shall send a written notice by e-mail to ksambuca.art@gmail.com, as well as inform of its withdrawal by means of cellular communication / WhatsApp.
– The Buyer shall independently cover any additional customs fees required in its country.
The Seller shall:
– Send the selected Painting to the Buyer within ten business days from the date of payment.
– In case of delivery by transport company, the obligation of the Seller to transfer the Painting shall be deemed to be fulfilled upon and after transfer of the Painting to the transport company.
– Seller shall review the letters for return of Paintings within 14 business days upon and after their receipt. If the Seller fails to respond to the request to review the complaint within the specified time frame, it shall automatically be deemed positive.
– The Seller shall reserve the right to refuse to consider a return if it is due to a color difference in the goods purchased, as the hue and temperature of the colors may vary slightly depending on the screen settings and calibration.
– Upon return or rejection of a purchase, the Seller shall refund all payments made by the Buyer (including delivery charges) within 14 calendar days. The return shall be made for the same form of payment that was used by the Buyer when purchasing, unless the Buyer itself has agreed to a different form of return that does not involve any additional cost to it.
– The Seller shall reserve the right to withhold refunds until receipt of the returned goods or proof of return.
– The Seller shall not be liable for the terms of delivery of the Painting by the transport company, and in case of damage to the Painting in the process of delivery.
Final Provisions
The regulations shall come into force from the date of their publication on the Store’s website. The Seller shall reserve the right to change the regulations. Any amendments shall be published on the Store’s website.
In matters not regulated by the Regulations, the provisions of the Civil Code shall apply.
